We at Jein Solicitors are committed to our clients dealing with both, contentious or non-contentious litigation. This means that we are specialised in matters that involve attendance at court, and those that can be dealt with in an amicable settlement without the need for Court hearings. We understand that each case and each person is different, regardless of the particular area of law being dealt with, and we therefore tailor each case based on its particular facts to the individual. The Department’s ethos is to resolve matters using the Pre-Action Protocols without the need for unnecessary expenses involved of Court Hearings. However, matters involved in this particular area of law can unfortunately and occasionally end with hearings at Court. We understand that disputes arise from time to time, sometimes because mistakes have been made, issues overlooked, or somebody has simply done the wrong thing. We deal with both private and commercial litigation and will ensure that you are given effective and appropriate advice. We believe in being proactive when it comes to dealing with these types of cases and use every method of resolving disputes including negotiation, mediation, arbitration as well as litigation. We will do what we can to provide an alternative to actually going to court, therefore reducing stress, time and costs. If a particular case has to be resolved at Court, we have a specialised panel of Barristers to help with your case. Our Civil Litigation department currently handles several areas of Law:

  • Bankruptcy Proceedings
  • Housing (Eviction and Possessions)
  • Breach of Contracts
  • Breach of Leases
  • Debt
  • Negligence
  • Injunctions
  • Negotiations

Nobody likes to consider what will happen after his or her death, but a little thought now could save your family a lot of anguish at what will already be a very difficult time. Even the happiest of families can be reduced to arguments when a loved one dies without leaving a Will.

Making a Will gives you the opportunity to choose what happens to your estate, rather than relying on the legal rules which operate on an ‘intestacy’, which means when no Will is left. Whether single, married or a parent, a will is a key element in estate planning and, without one; you are unable to control what happens to your assets after death. You may leave your dependants with numerous problems, including an unmanageable tax burden; and yet the Law Society reports that two out of three people have not made a Will.

Wills

Without a Will, the law will determine how your estate will be distributed, so your family, friends and favourite charities may not receive what they need or expect. We can help you to make the correct provisions and ensure that your wishes are carried out:

  • 1 Draw up your Will, making provision for all the people important to you
  • 2 Ensure that your wishes are carried out and that you fully understand the draft
  • 3 Advise on Inheritance Tax to minimise your tax liabilities
  • 4 Advise on your assets to ensure wealth protection
  • 5 Arrange signing of your Will and retain it for safe–keeping

We can now register your Will with the first online register of Wills, called Certainty, which means that your loved ones will be able to find out which solicitor holds your Will, should they not know when the time comes to find it. We particularly encourage property owners to make a Will. For most people your house is your biggest asset. It is important that those you want to inherit are protected.

Probate

We are also able to assist constructively and compassionately with the many legal and practical points issues which follow bereavement. We can offer straightforward advice in relation to the obtaining of a Grant of Probate or Letters of Administration or we can deal with a complete application for you. Please contact us for a preliminary discussion of your requirements and to arrange an appointment.

We offer competitive rates, and are happy to discuss our fees with you. We want to reassure you that the most important thing is to fully understand your instructions and it will be helpful if you could answer the following questions ahead of our first meeting:

  • Your full name, address, email address, telephone number and date of birth
  • The name, address, email address, telephone number and date of birth of your spouse/partner
  • Marital status – are you single, married, intending to marry, cohabiting or divorcing?
  • Your National Insurance number
  • Names and dates of birth of your children (please specify any who are stepchildren or adopted)
  • Details of guardians for children under 18 (names, addresses and relationship to you)
  • Details of your assets (house, bank accounts, shares etc.)
  • Please list these and indicate if they are in joint names
  • Please give details of your liabilities (mortgage, credit cards and any debts)
  • Approximate value of your property and any outstanding mortgage liability

If you already have a Will, please state who holds it When we meet we shall go through your choice of executors, your funeral wishes, gifts, your preferred distribution of your estate and other matters.
